You will typically be assessed for the 100 visa about 2 years after lodging your original 309 visa application, provided your relationship is ongoing and genuine.
Yes. If you were in a long-term relationship at the time of your 309 visa application (e.g. 3+ years or 2+ years with children), you may be eligible for early grant of the 100 visa.
You may still qualify for the 100 visa in certain situations, such as family violence, the death of your partner, or shared custody of a child. Legal submissions are required.
